This policy explains what personal information BoyerBrush collects through boyerbrush.ca, when you buy from us or when you contact us, how we use and share it, and what your rights are under Québec and federal privacy laws.
1. Who we are
boyerbrush.ca is operated by BoyerBrush, a company based in Vaudreuil-Dorion, Québec, Canada.
2. What we collect
Depending on how you use the site, we may collect your contact details (name, billing and shipping addresses, e-mail address and phone number), your order details and your sign-in details if you create an account. We may also collect payment confirmation details (such as whether the payment was approved, the card type and its last four digits), what you write to us, your cookie, region and language choices, and technical data such as your IP address and browser type.
We collect this information when you place an order or create an account, fill out our contact or reseller form, sign up for our e-mails, or write to us. Some of it, such as technical data, is also recorded automatically, including through cookies, when you browse the site or place an order. Your card number is entered in our payment processor’s form. We also receive information from our payment processors and shipping partners, such as payment approval and delivery status.
We do not sell or rent your personal information to other businesses for their own marketing. You can browse the site without giving us your name or contact details. If you choose not to give us information we need, however, we may not be able to fill your order or answer your request.
3. Why we use it
We use personal information to process, ship and deliver your orders, send you order and shipping updates, manage your customer account if you create one, handle payments, invoices and refunds, keep our accounting records, and answer your questions, warranty claims and reseller requests. We also use it to prevent fraud, protect the site and remember your region, language and cookie choices. We may use what you tell us to improve our products.
We send e-mails about our products, promotions and news only to people who have asked for them, by ticking the box at checkout or by signing up in the form at the bottom of the site. When you sign up through the form, we first send you a confirmation link. We keep a record of your consent: the e-mail address, the date and the wording you agreed to. Every e-mail of this kind includes an unsubscribe link, and you can also unsubscribe at any time through our contact form.
Our web server automatically records each request made to the site, including the IP address, the page requested, the date and time, and the browser used. We use these records to keep the site secure, to detect and respond to misuse, and to produce statistics on how the site is used.
4. Who we share it with
We share personal information with service providers that help us run the shop, including our payment processor (Stripe, which handles credit and debit cards, Apple Pay and Google Pay), shipping platforms and carriers, accounting software, e-mail services, our website host (HostGator), and website tools such as the cookie banner (CookieYes, which runs on our own site), the anti-spam check on our forms, the customer-reviews display, embedded videos (YouTube and Vimeo) and the store map on our Find a Retailer page (Google Maps). We give them the information they need to provide their services, for example your contact details and order details. Some of them, such as our payment processor and carriers, may also use it for their own fraud prevention and security needs and to meet their legal obligations, under their own privacy policies.
The store map on our Find a Retailer page comes from Google Maps. When that page opens, Google receives your IP address and the address of the page. When you search for a store, Google also receives the postal code, city or address you type, to locate it. If you use the “Use my location” button, your browser first asks for your permission; your position is then used on your device to sort the stores by distance, and we do not receive or keep it.
Some of our service providers store or process information outside Québec, in other parts of Canada and in the United States. In particular, our website is hosted by HostGator in the United States, and Stripe, Google, YouTube and Vimeo process information there. Information kept outside Québec is subject to the laws of the places where it is kept.
We may also communicate personal information for tax and accounting purposes, for example to tax authorities.
5. How long we keep it
We keep personal information for the periods below. When a period ends, we destroy the information or anonymize it.
- Orders, invoices and payment records: generally six years after the end of the tax year they relate to, as federal and Québec tax laws require.
- Customer accounts: until the account is closed, at your request or ours. The orders, invoices and payment records of a closed account are still kept for the six-year tax period above.
- Messages and form entries: while we deal with your request and any follow-up, such as a warranty claim.
- Technical data: as long as it is needed to protect the site or, when it is recorded with an order, as long as that order is kept.
6. Cookies
A cookie is a small file placed in your browser. On your first visit, a banner lets you accept or refuse non-essential cookies, and you can change your choice at any time.
Necessary cookies keep the cart, checkout and sign-in working, remember your region, language and cookie choices, and help a security service detect robots. Our card payment processor also sets cookies to detect fraud, for example on the cart and checkout pages. Necessary cookies cannot be turned off in the banner.
Some videos on our pages are played from YouTube and Vimeo. These services may set cookies when a page with one of their videos loads or when you play it, under their own policies.
You can also delete or block cookies in your browser settings, but some parts of the shop, such as the cart and checkout, may not work.
7. Your rights
Subject to the exceptions provided by law, you may ask to see the personal information we hold about you and get a copy, have it corrected or deleted as the law provides, and withdraw your consent to our use or communication of it. Withdrawing your consent may prevent us from filling an order or answering a request. You may also ask us to close your customer account. Invoices and payment records are not deleted on request: they are kept for the tax period explained in section 5.
To make a request, write to the person in charge of the protection of personal information (see section 12). We may ask you to confirm your identity, and we answer within the time limits set by law.
If you have a concern or complaint about how we handle your personal information, write to the same person, who will review it and reply to you. If you are not satisfied with our answer, you may contact the Commission d’accès à l’information du Québec or the Office of the Privacy Commissioner of Canada.
8. Security
We take reasonable security measures to protect personal information. However, no website or system is free of risk, so we cannot guarantee complete protection.
Access to personal information is given to the people who need it for their work, such as handling orders, shipping, accounting, customer service or maintaining the site. Each person who has access must use it only for that purpose and keep it confidential.
9. Children
Our site is intended for adults, and we do not knowingly collect personal information from anyone under 14 years of age. If you believe a minor has given us information, contact us and we will take appropriate steps.
10. Other websites
Retailers and other websites that we link to may have their own privacy policies. This policy does not cover how they handle your information, including when you buy from them, and we are not responsible for their practices.
11. Changes to this policy
We may update this policy from time to time. When we do, we give notice as the law requires, and the date at the top shows when it was last updated.
12. Person in charge of the protection of personal information
At BoyerBrush, any question, request or complaint about your personal information is handled by the Privacy Officer, who is the person in charge of the protection of personal information. You can reach the Privacy Officer using the contact details below.
